    Judge Rules…..Clinton Foundation Can Proceed

    Federal Judge Rules Whistleblower Case Against Clinton Foundation Can Proceed

    A federal judge on Oct. 8 ruled that a whistleblower complaint against the Clinton Foundation can proceed, saying that the IRS “abused its discretion” in attempting to dismiss allegations of wrongdoing by the nonprofit organization.

    U.S. Tax Court Judge David Gustafson last week found that the complaint, brought by whistleblowers Lawrence Doyle—a corporate tax compliance expert, and John Moynihan—a former Drug Enforcement Agency (DEA) official, “provided ‘specific credible documentation’ supporting their allegations” that the Clinton Foundation potentially evaded paying taxes on millions if not billions of dollars.

    The judge struck down the Internal Revenue Service’s (IRS) request for a summary motion. He said that its Whistleblower Office (WBO) was wrong in denying the whistleblowers’ claims based on an email from the agency’s Criminal Investigation (CI) office that said the complaint was closed.

    The record “fails to support the WBO’s conclusion that CI had not proceeded with any action based on petitioners’ information. Accordingly, we deny the motion on the grounds that the WBO abused its discretion in reaching its conclusion, because not all of its factual determinations underlying that conclusion are supported by that record,” Gustafson wrote.

    Gustafson also said that based on evidence, he had reason to believe that the FBI was involved in an IRS investigation. He cited information contained within IRS records that had until now been kept secret from the public, in which Doyle and Moynihan discuss their contacts with law enforcement officials.

    “The FBI in [redacted] has thanked us profusely and praised our report excessively. As one individual close to the investigation commented to me, ‘you and your colleagues have saved numerous federal agents thousands of hours of work,’” the judge quoted in his ruling.

    The two financial investigators said they first submitted their complaints that they believe show the nonprofit, founded by Bill and Hillary Clinton, evaded taxes, to the IRS office in Ogden, Utah, in August 2017. They told a House subcommittee on government operations in December 2018 that they had submitted thousands of documents to the IRS.

    Doyle and Moynihan looked at the foundation’s tax returns, other publicly available data, and interviewed several foundation employees. They tried to match what was being spent on charitable giving and how much was set aside for things such as travel, salaries, and administration expenses.

    Among other things, they found that about 60 percent of the foundation’s income was spent on things like salaries, travel, and grants. Moynihan said he believed a good charity would only spend about 15 percent on such things.

    Rather than a charity, Doyle and Moynihan called the foundation a “closely held partnership.”

    Further, they said they reviewed some emails that showed the Clintons had been approved to accept funds for Bill Clinton’s presidential library but were in talks with potential donors about health programs that weren’t part of the library’s mission, according to the articles of incorporation.

    Based on their research, Doyle and Moynihan believe the Clintons owe taxes on between $400 million and $2.5 billion; if the IRS finds that the foundation isn’t a charity, its donors might also be liable for taxes owed on their contributions. They also said that, while not looking for this specifically, they did find instances of “pay-to-play” behavior between the donors, the foundation, and Hillary Clinton’s position as secretary of state, which she held from 2009 to 2013.

    Based on an interview with a former employee, they said Bill Clinton regularly “mixed and matched, on an ongoing basis, his business with that of the foundation.”

    In the whistleblowers’ latest filing, they have requested court permission to take a deposition from Jimmy Corley, the chief of accounting compliance for Arkansas. According to Just the News, the request has been sealed by the court.

    The Epoch Times reached out to Corley for comment, but didn’t immediately hear back.

    First up is a case from Alabama. A US district court judge, Abdul K. Kallon, an Obama appointee took it upon himself to rewrite the Alabama election statutes. Kallon ruled that the ban on curbside voting, the requirement that absentee ballots be signed by a notary or two witnesses, and the requirement for a photo ID with absentee ballot applications, as applied during the COVID-19 pandemic, violated federal law.

    The 11th Circuit Court issued a stay today preventing most of Judge Kallons order from going into effect while the case makes its way through the appeals process. The only thing the 11th left standing was the curbside voting, which allows any municipality to do so if it wants.

    The next case comes out of Texas, where Governor Greg Abbot limited the number of ballot drop-boxes to one per county. He had previously issued an order allowing “drop-boxes” without restriction on number.

    Judge Robert Pittman, an Obama appointee, held that infringed on Texan’s 1st and 14th amendment rights because covid or something.

    The Fifth Circuit Court of Appeals granted a stay against the Order of Judge Pittman today. They ruled that even with the limited drop-box availability, the fact there were drop-boxes at all were an expansion of voting rights, not a burden.

    US District Court Judge Dan Polster, a Clinton appointee, tried to rewrite Ohio election law only to be reversed by the 6th Circuit Court of Appeals. Polster had issued an injunction preventing the Ohio secretary of state from limiting the number and make-up of ballot collection boxes. From the 6th Circuit ruling:

    The district court enjoined Ohio Secretary of State Frank LaRose from enforcing his directive that absentee ballot drop boxes be placed only at the offices of the county boards of elections. Secretary LaRose appealed to this Court, and now moves for an administrative stay and a stay of the district court’s injunction pending appeal…. we grant the motion for a stay pending appeal….



    We wrap up the wrap-up with a case out of Missouri that isn’t quite settled yet. Back in June, the Missouri legislature amended the laws there to allow an option for all registered voters to cast a “mail-in” ballot for elections in 2020.  These are referred to in the legislation as “remote ballots.” The legislation requires remote ballots to be delivered by the USPS while normal absentee ballots can be delivered in person as well as by mail. District Court Judge Brian Wimes, an Obama appointee, decided he didn’t like the delivery options for the ballots so he changed it to a procedure he liked better, all ballots not cast in-person at a polling location may be delivered in-person by the voter to Missouri election officials, the “remote ballots” must be received by Missouri in the same manner as the “absentee ballots.” He simply eliminated the requirement that the “remote ballots” be delivered only by the Postal Service.

    This case is still wending its way thru the courts, and given the decisions from the various Circuit Courts, I would be surprised if the injunction stands.

    This just crossed the transom, SCOTUS has overruled the 9th circuit and ended the 2020 census count. The 9th had ordered the government to continue until 31 October. The unsigned SCOTUS order ends the count immediately.


    Today is 13 October. There are 80 days left in the year. Why do I bring that up? Chicago already has the most murders and shootings in more than 25 years. There have been 600 murders so far in 2020, a 50% increase over last year.

    California is warning voters not to sanitize their ballots by putting them in the microwave or covering them with hand sanitizer. Yes, I’m being serious. It seems that a goodly number that have been returned were either doused in alcohol based hand sanitizer or microwaved.

    The Supreme Court has refused to take up the emoluments clause case brought by House Democrats.

    The Justices refused to hear an appeal by 215 Senate and House Democrats of a lower court ruling that found that the lawmakers lacked the necessary legal standing to bring the case that focused on the Republican president’s ownership of the Trump International Hotel in Washington.

    In the case brought by congressional Democrats, the U.S. Court of Appeals for the District of Columbia Circuit in February ruled that individual members of Congress have limited ability to litigate questions affecting the legislative branch as a whole.

    That puts a stop to this little part of the resistance theater. Unfortunately, there are a couple of other suits percolating through the courts on this issue.

    There’s a new-ish report from the CDC that’s making the rounds. It was in last week’s Morbidity and Mortality report. The report states that 85% of those who caught the Chinese Lung AIDS in July claimed they wore a mask “often” and that 70% claimed they wore a mask “always”. And just 3.9% of those infected reported never wearing a mask.

    Two things are going on with that report as far as I’m concerned. First, they’re relying on “self-reporting”. Mask compliance may have been on the upswing in July, but 85%? Yeah I doubt that.

    The other issue I have with this report is that it just shows a single data point. We have no idea if any of the other factors involved in transmission are present, and how or even if they’re accounted for in this study.

    I’m on the record as saying I don’t think masking works, at least not the way the corporate media is portraying it. Frankly, I distrust any report in the subject, regardless of conclusion, created since April. What I do trust are the volumes of reports produced in the months and years prior to the Chinese coronavirus outbreak showing unequivocally that masking is only slightly effective, if all protocols are followed and specific types of mask are used.


    The American Bar Association has issued their rating of ACB. They think she’s “well-qualified” to be a Supreme Court Justice.


    Dunno if anyone cares or not, but the LA Lakers won the NBA championship last night. I Really don’t care, and can’t even be bothered to google who they played or anything else, the reason I mentioned it is some Los Angelinos used the victory(?) as a pretext to loot and riot. There were 78 arrests made and 8 officers were injured.

    On a moonless night, an Army Chinook helicopter swept low over the Tangi Valley, a strip of  forbidding terrain in eastern Afghanistan teeming with Taliban and located just 35 miles south of the capital, Kabul.

    Among the 38 occupants inside the Chinook were some of the most highly trained and battle-seasoned fighters in the U.S. military, including 15 commandos from the Navy’s SEAL Team 6, the unit that three months earlier had killed Osama bin Laden.  Their target was a Taliban commander responsible for ambushes and other attacks against U.S. and Afghan forces.

    Joe Morgan, Cincy 2nd Baseman, dead at 77

    Joe Morgan, Hall of Fame second baseman who was a big part of the Big Red Machine has died. He was 77. Morgan passed away at his home in Danville, California, Sunday. Morgan was suffering from a nerve condition, a form of polyneuropathy.

    Morgan’s death is the latest among a string of major league greats this year: Whitey Ford, Bob Gibson, Lou Brock, Tom Seaver and Al Kaline.

    Morgan was a two-time NL Most Valuable Player, a 10-time All-Star and won five Gold Gloves. In his 22-year career Morgan scored 1,650 runs, stole 689 bases, hit 268 homers and batted .271.

    He is survived by his wife of 30 years, Theresa; twin daughters Kelly and Ashley; and daughters Lisa and Angela from his first marriage to Gloria Morgan.

    Court Packing is becoming a problem for Joe. The media is attempting to change the narrative for him. They’re trying to make it seem that the Constitutionally mandated duty to nominate a Justice when there is a vacancy is “packing the court”. And at the same time, they’re attempting to paint adding members to the high Court as “court reform.”

    Court packing has a specific meaning and it doesn’t mean filling, or not filling, seats in accordance with the Senate’s constitutional responsibility. It specifically means adding seats to the Supreme Court to make it more fit your political will.

    The Presidential Debate scheduled for Thursday has been cancelled. The “non-partisan” presidential debate commision dropped the town hall style event after several embarrassing gaffes this week. First, they changed the event to a virtual one without bothering to ask either of the campaigns. Next, the moderator for that event C-SPAN’s Steve Scully got caught playing twitter footsie with former Trump aide Anthony Scaramucci. When that was outed, Scully blamed the tweet on hackers, because of course he did. How Scully, a former Biden intern and clear never-Trumper got the nod, I’ll never know.


    Haven’t heard much about the plot to kidnap and possibly murder Gretchen Whitmer have you? Turns out, there are far more connections to the left than there are to the right. Go figure. . . .


    North Korea held a military parade in honor of the 75th anniversary of the (mis)rule of the Workers party. It contained most of the same stuff we’ve grown accustomed to seeing from the North Korean regime, battalions of troops passing in review, formations of tanks and IFV, MLRS systems and the like. Two things stood out to me. First were the super awesome MiG 29 and SU 25 fighters with neon lightstrips.

    Second, was the giant ICBM and 11 axle TEL it was mounted on. Unlike some of the ICBM displayed at past mil parades, this one looks like a complete system.
