    Special Prosecutor David Weiss had indicated he intended to bring federal weapons charges against Hunter Biden, son of President Joe Biden, by the end of the month in a pleading filed with the United States District Court in Delaware on September 6.

    Following years of investigation and a scuttled plea deal that would have granted Hunter Biden broad immunity, the Department of Justice (DOJ) has now followed through and formally indicted him on federal firearms charges.

    Biden is accused of lying about his drug use when he bought a firearm in October 2018, a period when he has acknowledged struggling with addiction to crack cocaine, according to the indictment filed in federal court in Delaware.

    President Joe Biden’s son has also been under investigation for his business dealings. The special counsel overseeing the case has indicated that charges of failure to pay taxes on time could be filed in Washington or in California, where he lives.

    The indictment remains sealed at the moment, but based on the Status Report filed by the DOJ last Wednesday, the statutes under which they are charging Biden are Title 18, United States Code Sections 922(g)(3)and 924(a)(2) (2018), the pertinent portions of which are set forth below.

    Section 922:

    (g)It shall be unlawful for any person—

    (1)

    who has been convicted in any court of, a crime punishable by imprisonment for a term exceeding one year;

    (2)

    who is a fugitive from justice;

    (3)

    who is an unlawful user of or addicted to any controlled substance (as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802));

    Section 924(a)

    (2)

    Whoever knowingly violates subsection (a)(6), (h), (i), (j), or (o) of section 922 shall be fined as provided in this title, imprisoned not more than 10 years, or both.

    (The reference back to Section 922(a)(6) is as to making false statements in the attempt to acquire a firearm.)

    This is a breaking news story, and RedState will continue to provide updates as they become available, including sharing a copy of the indictment once it is unsealed.

    Cul-de-Sac Commandos Indicted

    You probably remember Mark and Patricia McCloskey, the St. Louis couple that defended their home from rioters that broke down their gate and menaced them on their own front lawn. You may also remember George Soros connected St. Louis prosecutor Kim Gardner, who used the pair in a fund-raising campaign, and not in a good way.

    Well, the latter has indicted the former on felony unlawful use of a weapon and tampering with evidence charges. The pair face up to four years in prison and the loss of their law licenses if convicted.

    It’s unclear where the tampering charge came from, but the McCloskeys have credibly accused Gardiner’s office of tampering with the pistol Patricia displayed during the incident.

    The McCloskeys claimed the pistol had been intentionally rendered incapable of firing, with a spring placed in front of the firing pin, because it was used as a prop in a previous lawsuit.  Assistant Circuit Attorney Chris Hinckley ordered the gun stripped and reassembled such that it could be operational.

    Biden Supporters Indicted for Robbery and Assault

    Two Biden Supporters have been indicted for robbery and assault for mugging a 7 year old for his MAGA hat and assaulting his mother and a good samaritan when they tried to intervene. I covered the initial story here.

    A grand jury has indicted Olivia Winslow and Camryn Amy, both 21 on felony charges of robbery, conspiracy and hate crimes and a misdemeanor charge of endangering the welfare of a child. Amy also was indicted on misdemeanor charges of assaulting a man who tried to retrieve the hat, attempting to assault his mother, and offensive touching of the boy.

    Watch:

    The incident drew the attention of some big names, and 7 year old Riley seems to have made out alright. The President sent him an autographed MAGA hat and a bunch of other Presidential SWAG.

  • Steve Bannon Indicted

    Steve Bannon Indicted

    Former Trump advisor Steve Bannon, along with Brian Kolfage and two others, has been indicted for allegedly siphoning off funds from the “Build the Wall” campaign.

    Bannon is accused of taking over $1 million from the campaign, which he allegedly used to “secretly pay Kolfage” and to “cover hundreds of thousands of dollars in Bannon’s personal expenses.” The alleged fraud involved funneling payments from the We Build the Wall campaign to Kolfage through a shell company controlled by Timothy Shea, one of the men being indicted.

    Read the indictment below:

    According to the indictment, the money was given to Kolfage through fake invoices and false “vendor” arrangements. This was done to conceal the fact that the veteran was being paid a salary despite telling donors that he was not receiving a penny.

    The four men were arrested by U.S. Postal Service agents on Thursday and are expected to appear in court later in the day. Prosecutors are charging them with conspiracy to commit wire fraud and money laundering.

    Inspector-in-Charge Philip R. Bartlett said, “This case should serve as a warning to other fraudsters that no one is above the law, not even a disabled war veteran or a millionaire political strategist.” If convicted, the men face a maximum of 20 years in federal prison.

  • Durham Collects First Scalp

    Durham Collects First Scalp

    US Attorney John Durham has collected his first scalp in his criminal investigation into the origins of the Obama administration’s phony Russia investigation.

    Durham was tapped by Attorney General William Barr in May of 2019 to investigate the Russian collusion hoax and determine whether any criminal charges against those who perpetrated it were warranted.

    Kevin Clinesmith, a former FBI lawyer and member of the Meuller team, is expected to plead guilty felony charges of making false statements.

    Clinesmith is the first person indicted in Durham’s probe. Read the full indictment below:

    From the Federalist:

    Clinesmith’s deliberate falsification of a federal spy warrant was first revealed last December following a lengthy investigation by the Department of Justice (DOJ) Office of the Inspector General (OIG), headed by Michael Horowitz. Horowitz and his team wrote in a 434-page report that Clinesmith — identified in the report as “OGC Attorney” — altered an email from a separate U.S. federal agency, believed to be the Central Intelligence Agency (CIA), to falsely state that Page had never worked with the CIA to investigate suspected Russia agents operating within the U.S. In fact, as Clinesmith was told by the operative, Page had worked with the CIA previously, as well as with the FBI.

    According to the OIG report, Clinesmith “[o]mitted Page’s prior relationship with another U.S. government agency, despite being reminded by the other agency in June 2017, prior to the filing of the final [FISA warrant] renewal application, about Page’s past status with that other agency.”

    “Instead of including this information in the final renewal application,” the OIG report stated, Clinesmith “altered an email from the other agency so that the email stated that Page was ‘not a source’ for the other agency, which the FBI affiant relied upon in signing the final renewal application.”

    AG Barr appeared on Sean Hannity’s show Thursday night and said there would be developments in the Durham investigation and that more would be coming. “Things are moving along at the proper pace as dictated by the facts in this investigation,” Barr said.
