    In a release, Chief Justice John Roberts stated the matter would go directly to the Marshal of the Supreme Court, a law enforcement official that answers directly to the court.

    “To the extent this betrayal of the confidences of the Court was intended to undermine the integrity of our operations, it will not succeed,” Roberts wrote.

    “The work of the Court will not be affected in any way.

    “We at the Court are blessed to have a workforce – permanent employees and law clerks alike – intensely loyal to the institution and dedicated to the rule of law,” the statement continued.

    “Court employees have an exemplary and important tradition of respecting the confidentiality of the judicial process and upholding the trust of the Court. This was a singular and egregious breach of that trust that is an affront to the Court and the community of public servants who work here.

    “I have directed the Marshal of the Court to launch an investigation into the source of the leak.”

    The current Marshal of the Supreme Court is Col. Gail A. Curley, according to Fox News, who was appointed in May of 2021.

    Very very obviously, one of the employees is NOT ”exemplary” nor cared a whit for the ”tradition” of the court.

    I continue to wonder why he does not state that he has directed the ”Marshal of the Court” to polygraph all employees with the exception of the Justices.

    Biden Gives the Game Away in His Statement About SCOTUS Leak

    This leak from the SCOTUS that indicates they might overturn Roe v. Wade isn’t an accident. It likely was about trying to gin up the anger from liberals to be able to have a focal point for November. They were going into November with a very unpopular person in the White House, failed policies, record-high inflation, and Democrats who had no interest in voting or who might even be flipping to Republican. And naturally, they’re not even being honest about what this decision may mean — that even if it turns out to be the final decision, the “choice” is given back to the states. If they believe they have the majority, then they can pass laws based on that — that’s the way the system is supposed to work, without legislating from the bench.

    Now, Joe Biden has made an official statement on the SCOTUS leak in which he gives the game away. Not only is he commenting on an incredibly important ongoing case — something he should never do in his position. But he’s also ginning up the situation still more to use the leak to hype voting for Democrats in November. That’s what all this was about — to fire up the left.

    We do not know whether this draft is genuine, or whether it reflects the final decision of the Court.

    With that critical caveat, I want to be clear on three points about the cases before the Supreme Court.

    First, my administration argued strongly before the Court in defense of Roe v. Wade. We said that Roe is based on “a long line of precedent recognizing ‘the Fourteenth Amendment’s concept of personal liberty’… against government interference with intensely personal decisions.” I believe that a woman’s right to choose is fundamental, Roe has been the law of the land for almost fifty years, and basic fairness and the stability of our law demand that it not be overturned.

    Second, shortly after the enactment of Texas law SB 8 and other laws restricting women’s reproductive rights, I directed my Gender Policy Council and White House Counsel’s Office to prepare options for an Administration response to the continued attack on abortion and reproductive rights, under a variety of possible outcomes in the cases pending before the Supreme Court. We will be ready when any ruling is issued.

    Third, if the Court does overturn Roe, it will fall on our nation’s elected officials at all levels of government to protect a woman’s right to choose. And it will fall on voters to elect pro-choice officials this November. At the federal level, we will need more pro-choice Senators and a pro-choice majority in the House to adopt legislation that codifies Roe, which I will work to pass and sign into law.

    What was that about the norms again? The leak has already put the Court and the Justices in danger. Now, Biden is increasing that with his comments, saying that “basic fairness and stability of our law demand that it not be overturned.” Notice what’s missing there? The Court is supposed to be about the Constitution and not legislating from the bench. It’s not about complying with the mob, politics, or “fairness.” Roe v. Wade was legislating from the bench, which is why the Court would throw it back to the states to do the legislating (if this decision remains the same). It’s not outlawing abortion — it will depend upon what the states (and the people’s representatives) decide, as it should have been from the beginning. This is putting this in the hands of the people. So if you think about it, the left — who is against this — is really against having people choose. They’re anti-choice.

    What’s ironic about all this is that once upon a time — before Biden had gone completely over to the left, when he was more in line with the majority and maybe closer to his Catholic origins — he pushed for a constitutional amendment that would overturn Roe v. Wade and allow states to choose their policies on abortion back in 1982. He also voted against abortion funding — a lot.

    Biden’s evolution is further evidence of how far left the Democrats have gone. His prior actions were before he needed the left to get power. We’ll have to see how much this energizes the liberals to come out to vote. I’m not sure that it will be enough to save them, but it may be all they have left to throw out there at this point. Because in the final analysis, people almost always vote with their pocketbooks and that isn’t looking good for the Democrats.

    Dershowitz: ‘There’s Never Been a Leak Like This’

    Monday night’s leaked Supreme Court draft to unravel the landmark Roe v. Wade decision on abortion appears not only to be authentic, but a deliberate attempt to “pressure” the justices, constitutional law expert Alan Dershowitz told Newsmax.

    “This has the sign of authenticity,” Dershowitz told Monday’s “Rob Schmitt Tonight.” “It also to me, and this is just a theory, but I think it’s maybe correct: The leak was very deliberately – perhaps by a law clerk who was very strongly opposed to reversing Roe v. Wade – seeking to make it public now so that pressure could be put on the Supreme Court, either by an act of Congress to pack the court, or an act of Congress making a federal legislative right of every woman to have an abortion based on the Commerce Clause.”

    Dershowitz, who has 57 years’ experience with the Supreme Court, having been a clerk and a Harvard Law professor, added that “in all the years I’ve been following the Supreme Court, there’s never been a leak like this.”

    “But this was not just an inadvertent leak,” Dershowitz told host Rob Schmitt as the news was breaking from the Politico-leaked draft. “I think this was an act of civil disobedience engaged in by a determined law clerk who thought it was so serious that a woman’s right to abortion will be taken away that they were willing to risk their bar, their career, their heritage on this, because this is going to be investigated.”

    The leaker – potentially trying to be a “hero of the left” – Politico, and the reporter are sure to be investigated amid an unprecedented set of circumstances, according to Dershowitz.

    “The FBI is going to be called in,” he continued. “There’s going to be an attempt to break the journalist privilege. There’s going to be an attempt to call Politico and demand of them that they reveal the source.

    “Politico won’t do it, but the case may go all the way to the Supreme Court on that issue as well.”

    Dershowitz noted Supreme Court Chief Justice John Roberts, his own law student, has to be frustrated he has lost control amid years of partisan attacks on the independence and balance of the court.

    “This is a monumental day,” Dershowitz said. “Chief Justice Roberts is just so upset, I can imagine, because he’s lost control. People will think, at least, he’s lost control of the court.”

    While the leaker might become a “hero of the left,” Dershowitz said, adding, if revealed, “they won’t be practicing law anymore.”

    “They will be disbarred if this comes to light, and we may never know who leaked it, but we may find out, and that person will lose her or his career but will become a hero to the left,” Dershowitz said. “So it’s a very important day in Supreme Court history.

    “It will also result in a tightening up of the hiring of law clerks and making it explicitly a crime to reveal information from the inner workings of the Supreme Court. In all my years of following the Supreme Court and being a professor, nothing like this has ever occurred.”

    Dershowitz, knowing the writings of Justice Samuel Alito – who wrote the draft majority opinion that was leaked – said there is just a 2% chance this is a “fake” news report.

    “There’s a 2% chance there’s no truth to this – that somebody created a fake story – but I can’t imagine that Politico would risk its reputation,” Dershowitz said.

    Ultimately, “the dignity of the Supreme Court in the United States,” Dershowitz said, “suffered a terrible blow today.”

    “The argument is really about the power of the Supreme Court to change 50 years of law simply based on new justices being appointed, and that’s going to be upsetting to Stare Decisis – the concept that you leave the law alone unless there are compelling reasons for changing,” Dershowitz concluded.

    I will make no attempt to address all his points.

    His statement that Justice Roberts has ”lost control” is exactly correct. personally, one wonders if he ever had control.
    As to the Court suffering “a terrible blow”, saying it was sabotage may be extreme; however, it is very close.
