    Despite everything that Chuck Shumer tried, the Senate invoked cloture on the House spending continuing resolution. The final vote was 62-38. 10 Dems crossed the aisle for this procedural vote to end debate in the resolution. They were:

    This is a big loss for the Dems. Despite all their histrionics since the CR cleared the House, they proved impotent when it came time to hold the votes.

    I think they mostly realized any shutdown would have been – rightfully – laid at their feet.

    According to multiple reports yesterday, Kristin Gillibrand could be heard yelling at the top of her lungs about it from outside of a Dem caucus luncheon event yesterday. She was not happy about the hard line Chuck Shumer had taken and made sure the rest of the caucus heard about it. Chuck’s opposition to the CR can be summed up by something the Bard said: it is a tale told by an idiot, full of sound and fury, signifying nothing.

    This all but guarantees the CR will pass this evening, as the Republicans have the votes needed to send the spending bill to the President’s desk.

    Guess How the Biden Admin Responded to Senators Demanding Answers About Pentagon Official’s Ties to Iran

    The Biden administration has not been quick to provide answers or an explanation about a senior Pentagon official’s reportedly close ties to the Iranian regime and members of Congress are ramping up pressure for details about how someone who frequently communicated with Iranian officials for help with talking points before making public remarks ended up in a sensitive post in the Department of Defense. 

    Ariane Tabatabai, who currently serves as chief of staff to the Assistant Secretary of Defense for Special Operations and Low Intensity Conflict, reportedly worked with an Iranian program to influence opinion in Tehran’s direction as Townhall previously reported.

    More than thirty U.S. senators signed on to a rightfully pointed letter sent on September 29 to Defense Secretary Lloyd Austin demanding answers by Friday for what they say is a “simply unconscionable” reality in which a “senior Department official would continue to hold a sensitive position despite her alleged participation in an Iranian government information operation.”

    The senators’ letter again reiterated what is — so far at least — known about Tabatabai’s ties to Iran:

    On Tuesday, September 26, Semafor reported that Ariane Tabatabai, who currently serves as chief of staff to the Assistant Secretary of Defense for Special Operations and Low Intensity Conflict (SOLIC), was part of a so-called Iran Experts Initiative that “senior Iranian Foreign Ministry officials initiated [in] a quiet effort to bolster Tehran’s image and positions on global security issues – particularly its nuclear program.”

    According to communications that Semafor reviewed, Ms. Tabatabai agreed to join the Iranian government-linked Initiative in early 2014, after meeting a Germany-based Iranian diplomat in Prague. On at least two occasions, Ms. Tabatabai “checked in with Iran’s Foreign Ministry before attending policy events.” The report details one occasion in which an Iranian think tank chief, who acted as an apparent liaison to the Iranian Foreign Minister, dissuaded Ms. Tabatabai from participating in a conference in Israel when she asked for his feedback. The report also indicates that Ms. Tabatabai potentially sought the Iranian government’s input on a congressional briefing that she was invited to give in July 2014.  

    Concerns about Ms. Tabatabai are not new. In March 2021, shortly after Ms. Tabatabai was appointed senior adviser in the Office of the Undersecretary of State for Arms Control and International Security, Iranian dissidents noted Ms. Tabatabai’s long history of echoing the Iranian regime’s talking points. In April 2021, several House members requested a review of Ms. Tabatabai’s security clearance. In response, the Biden administration dismissed these allegations as “smears and slander.”  

    The latest allegations reported in Semafor, however, indicate that Ms. Tabatabai may have been engaged in a relationship with the Iranian regime well beyond what even her strongest critics alleged. The fact that the Department initially responded to these latest allegations by rushing a full-throated defense of Ms. Tabatabai, rather than taking the time to ensure that our national security has not been compromised, suggests that you are protecting hiring missteps rather than prioritizing national security. 

    Iran continues to threaten U.S. military personnel in the Middle East and remains intent on assassinating American citizens here in the United States. Given these facts, we find it simply unconscionable that a senior Department official would continue to hold a sensitive position despite her alleged participation in an Iranian government information operation. While we note that Assistant Secretary of Defense for SOLIC Christopher Maier, who is Ms. Tabatabai’s current supervisor, testified before the House on Thursday that the Department is “actively looking into whether all law and policy was properly followed in granting my chief of staff top secret special compartmented information,” we urge you to suspend Ms. Tabatabai’s security clearance immediately pending further review, as the State Department did with her former supervisor, Robert Malley. 

    What has been reported and is so far known about Tabatabai is, as the senators note, alarming. But there’s still more that needs to be uncovered to understand exactly how this all came to pass. 

    To that end, the senators requested — with a deadline of Friday (October 6) — answers to the following queries:

    1. On what date did the Department of Defense learn that Ms. Tabatabai had served as part of the Iranian government-linked Iran Experts Initiative? 

    2. On what date was Ms. Tabatabai granted a security clearance, and what was the sponsoring agency that made the determination to grant Ms. Tabatabai a security clearance? 

    3. Has Ms. Tabatabai’s security clearance been subjected to a periodic reinvestigation and, if so, on what date was Ms. Tabatabai’s most recent periodic reinvestigation completed? 

    4. Was Ms. Tabatabai subjected to any additional counterintelligence screening, to include a polygraph investigation, as part of her security clearance investigation or any subsequent review of her eligibility to hold a security clearance or access restricted or special access information? 

    5. On her Standard Form-86, did Ms. Tabatabai list her contacts with: 

    a. Former Iranian Foreign Minister Javad Zarif; 

    b. Academic Adnan Tabatabai; 

    c. Mostafa Zahrani, the head of the Iran think tank IPIS; and/or 

    d. Former Iranian Foreign Ministry Spokesman Saeed Khatibzadeh? 

    6. Was Ms. Tabatabai read into any special access programs (SAPs)? 

    a. If so, was she subjected to enhanced security vetting, per SAP security policy, or was she granted a waiver? 

    b. If she was granted a waiver to be read into SAPs, which DoD official approved the waiver? 

    Already, the Biden Department of Defense has ignored inquiries from lawmakers in the House of Representatives, failing to respond to a letter raising similar concerns from the House Armed Services Committee.

    So, will the DoD respond to the letter from dozens of U.S. senators? Or continue hiding information about Tabatabai’s activities and knowledge inside the Pentagon? 

    Even if Tabatabai had zero access to sensitive information in the Pentagon — which is unlikely — the Biden administration’s apparent attempts to withhold information or cover up the issue only adds to the appearance of wrongdoing. It’s time for Secretary Austin and the DoD to show their cards so appropriate oversight and accountability can be carried out.

    Well, it only lasted a week, but if nothing else it provided some comic relief in a news cycle that’s generally flooded with one crisis or another. The “Fetterman rule,” as it came to be known, eliminating the dress code for the upper chamber was undone by a bipartisan resolution that drew unanimous support. Even Chuck Schumer, the author of the original change, voted to restore the previous dress code. All senators will be required to wear “business attire” on the Senate floor. The sponsors of the resolution were Joe Manchin and Mitt Romney. Fetterman himself did not offer a comment after the vote. But earlier in the day, he assured the rest of the Senate that would wear a suit whenever he is called upon to speak or preside over the chamber. (NY Post)

    The Senate passed a bipartisan resolution Wednesday to restore the formal dress code in the upper chamber following blowback over the loosening of the rule.

    Under the resolution, which passed unanimously, senators will once again be required to wear business attire on the floor.

    Majority Leader Chuck Schumer (D-NY) confirmed a rollback of the dress code last week and the move was quickly dubbed the “Fetterman Rule” over Sen. John Fetterman’s penchant for wearing hoodies and baggy shorts.

    It’s unclear whether Schumer really did have second thoughts about the change or he just didn’t want to face the embarrassment of coming out on the losing side of a 99-1 vote. But he had clearly gotten an earful over this in the days following the announcement. Virtually nobody else supported the idea, and it’s not difficult to imagine that nearly the entire body found Fetterman’s antics to be an embarrassment.

    But as I said, we at least had a few chuckles over the response. Almost immediately after the code was dropped, 70-year-old Susan Collins joked that she would wear a bikini to work. (At least I hope she was joking.) An image supposedly showing Senator Rand Paul wearing a bathrobe in front of the Capitol Building was making the rounds, but that turned out to be a fake AI photo. It was an impressive fake, though, and I thought it was real the first time I saw it.

    So will any lessons be learned from this episode, particularly by Chuck Schumer? He obviously felt as if he held the power to set the rules as he saw fit to make things convenient for his party. He quickly learned the hard way that that wasn’t the case. In his role as Majority Leader, Schumer is not a chief executive of any sort. He is more what would traditionally be considered “first among equals.” It’s a ceremonial role in any event. The phrase “majority leader” doesn’t even appear in the constitution. (The Speaker of the House is included, but it’s only mentioned once.)

    Even Fetterman hasn’t fully retreated. When he told his colleagues that he would be wearing business attire when speaking on the floor or presiding over the chamber, that was apparently just a compromise. He still intends to call out his votes from the cloakroom in other circumstances. So we can apparently look forward to the return of the hoodie and bike shorts in the near future.

    But we should be able to ask why that is. What is so special about Fetterman? He has now demonstrated that he owns at least one business suit and is either capable of dressing himself or has someone willing to help him with it. What’s preventing him from doing that on a regular basis? We heard several speeches from members supporting the return of the dress code who spoke of “reverence for the institution” and “the most basic expressions of that respect.” I take it none of that sank in for John Fetterman. He clearly has no respect for the institution that he asked to become a part of and, frankly, not a lot of respect for himself.

    Senate Majority Leader Chuck Schumer has agreed to schedule a vote to move the nominations of the Chairman of the Joint Chiefs of Staff, the Commandant of the Marine Corps, and the Army Chief of Staff forward. This signals a surrender by Schumer in his attempt to crush Alabama Senator Tommy Tuberville’s opposition to Secretary of Defense Lloyd Austin’s creation of an abortion tourism benefit in defiance of federal law.

    In July 2022, Lloyd Austin declared that the Supreme Court’s decision in Dobbs vs. Jackon Women’s Health adversely impacted military readiness because if pregnant members of the Armed Forces couldn’t kill their kids, they couldn’t do their jobs. To do this, Austin created a program that allowed military women seeking abortion to be reimbursed for travel expenses and take up to 21 days off — that is not charged against their annual leave balance — for the purpose of having an abortion. On the other hand, if one of your parents dies and you wish to go to the funeral, you pay your own way and get charged for leave. This is a clear violation of federal laws that forbid using federal funds for abortion. In December 2022, Tuberville announced that he would place a “hold” on all senior military promotions.

    All the hold does is prevent a few senior military officers from being confirmed in new positions by “unanimous consent.” This means each nomination will get a cloture vote before proceeding to a floor vote.

    Rather than do his job and call the needed votes, Senator Schumer and the Secretary of Defense carried out a public relations campaign to try and bully Tuberville into backing down. It didn’t work (see Alabama Senator Tommy Tuberville Reminds the Defense Department That One Determined Man Is a Majority and The US Marine Corps Doesn’t Have a Commandant Today Because ‘One Man With Courage Is a Majority.’

    By the time Schumer raised the white flag, he had created a stellar backlog of flag and general officer confirmation votes.

    By the end of the year, the Pentagon says that number could swell to 650 generals and admirals who need Senate confirmation before they can assume their jobs. Any single senator can put a hold on nominations under Senate rules.

    “The Department has 83 three- and four-star nominations pending for positions already vacated or due to rotate within the next 150 days,” the Pentagon said in response to questions by reporters. “Because of this blanket hold, for the first time in the history of the Department, three of our military services are operating without Senate-confirmed leaders. This is unprecedented, unnecessary and unsafe.”

    The Pentagon response is also bullsh** and validates what my colleague Bonchie had to say on the subject: U.S. Military Ranks Must Be Gutted by the Next Republican President.

    If the backlog is “unprecedented,” it is only unprecedented because Biden’s Secretary of Defense created a policy in defiance of federal law and in response to a Supreme Court decision he personally opposed. If it is unnecessary, it is only because Secretary Austin chose to become a scofflaw, and Senator Schumer was so focused on forcing Senator Tuberville to retreat that he allowed 20 months to elapse with no senior officer confirmation votes. The only thing “unsafe” about the exercise was letting Defense use officer promotions as a bargaining chip in their skirmish with a U.S. Senator.

    While the illegal and inhuman policy of subsidizing the murder of children in the name of “readiness” will continue, so will Senator Tuberville’s hold. And that is no small thing:

    If Schumer wished to confirm all of the nominees that are waiting on the Senate floor one-by-one, as he plans to do with these top-tier officials, a recent memo from the Congressional Research service found it could take as many as 89 8-hour workdays, during a time when Congress must manage a number of other priorities, including funding the government before Oct. 1 to avoid a shutdown.

    Not for nothing, the backlog of flag officer promotions is all on Chucky. The floor votes could have been held at any time. And honestly, the military isn’t suffering all that much from the fact the open positions aren’t filled. Were Marshall or Eisenhower still Chair of the Joint Chiefs very few of these ‘officers’ would be in positions of authority.

    Judge Rules Arizona’s Maricopa County Must Turn Over 2.1 Million November Election Ballots to Senate

    A judge on Friday ruled that Maricopa County must provide some 2.1 million ballots from the Nov. 3 election to the Arizona state Senate and allow access to its election equipment to conduct an audit.

    Maricopa County Superior Court Judge Timothy Thomason ruled that subpoenas issued by Arizona’s state Senate are valid and should be enforced, and he disputed arguments from Maricopa County officials saying the subpoenas are unlawful. The county previously stated that multiple audits have been sufficient and said ballots should be sealed.

    “The Court finds that the subpoenas are legal and enforceable,” Thomason wrote (pdf) in his ruling. “There is no question that the Senators have the power to issue legislative subpoenas. The subpoenas comply with the statutory requirements for legislative subpoenas. The Senate also has broad constitutional power to oversee elections.”

    He argued that the “Arizona legislature clearly has the power to investigate and examine election reform matters,” adding that senators can “subpoena material as part of an inquiry into election reform measures.”

    The move was hailed by Republican legislators in Arizona.

    Arizona Senate President Karen Fann, a Republican, told news outlets after the judge’s ruling that their move was “never about overturning the election, it was about the integrity of the Arizona election system.”

    “This was always about voter integrity and the integrity of the voting system itself,” Fann added.

    State Sen. Warren Petersen, a Republican, confirmed that the Senate will go through with a “forensic audit” of Maricopa’s Nov. 3 election results. Maricopa County, which includes Phoenix, saw more than 2.1 million people vote during the last election.

    But Bill Gates, the vice-chairman of the Maricopa Board of Supervisors, wrote Friday that the county has “nothing to hide,” adding that officials have “conducted three fully transparent audits, including two forensic audits by independent, qualified and outside Vote System Testing Laboratories.”

    “I trust the Senate will be completely transparent with the public as Maricopa County has been,” he added. “From the beginning, the County sought clarification from the court. The court has ruled. I look forward to working with the Senate to provide them the information they are requesting.”

    The subpoenas were issued following allegations of voter fraud and irregularities made by former President Donald Trump and surrogates including Rudy Giuliani.

    A dispute over the election began when former Senate Judiciary Chairman Eddie Farnsworth held a hearing to question county officials about the election. Farnsworth and Fann then issued several subpoenas, which prompted Maricopa County to issue a lawsuit. The subpoenas were re-issued in January.

    It’s not clear if the Maricopa Board of Supervisors will appeal Thomason’s decision. The Epoch Times has reached out to the county for comment.

    Georgia Senate Run-off Election

    Today is the day. Call me melodramatic, but the fate of our Republic rests on the outcome of the two US Senate run-offs happening in the Peach state today.

    The contests pit Republican incumbents David Purdue and Kelly Loeffler against Democrats John Ossoff and Raphael Warnock respectively.

    The winners could tip the balance of the Senate one way or the other. As it stands, the Republicans only need to pick up one of the two seats to hold their majority in the Upper Chamber of Congress.

    If the Democrats manage to pick up both seats, hold on to your hat. Biden and his handlers will ram through an incredibly leftist agenda and try to undo much of what this country stands for.

    The President has already tweeted about voting irregularities. It seems some Dominion voting machines in heavily Republican districts have had problems.

    According to her staff, Senator Dianne Feinstein’s mental decline has become so serious the staff compares her situation with “taking away car keys from an elderly relative.”

    It has been reported that Chuck Schumer has had conversations with her about stepping down as the ranking member of the Senate Judicial Committee.

    Jane Myer, of the New Yorker wrote:

    “Overtures were also made to enlist the help of Feinstein’s husband, Richard Blum. Feinstein, meanwhile, was surprised and upset by Schumer’s message. He had wanted her to step aside on her own terms, with her dignity intact, but “she wasn’t really all that aware of the extent to which she’d been compromised.”

    Writing for the Free Beacon, Graham Piro, wrote:

    ***”has issues with short-term memory, frequently forgetting briefings she receives from staff and becoming upset when she gets confused.”

    An individual, who is a former Senate aid, stated Senator Feinstein’s staff are in a difficult position. According to that person, Feinstein’s “staff is in such a bad position,” because “they have to defend her and make her seem normal.”

     In fact, it is not Senator Feinstein’s staffs job to “make her seem normal”. It is their job, as well as others within the Senate, to recognize what is happening and to step aside with her dignity intact.

    Though one may disagree with Senator Feinstein’s politics, one can still feel sorrow that her abilities are so diminished. Hopefully, someone will be able to gently guide her to doing the “right thing”.

    California Senator Dianne Feinstein announced that she’s stepping down as ranking Democrat on the Senate Judiciary committee.

    “After serving as the lead Democrat on the Judiciary Committee for four years, I will not seek the chairmanship or ranking member position in the next Congress,” Sen. Feinstein said in a statement. “I look forward to continuing to serve as a senior Democrat on the Judiciary, Intelligence, Appropriations and Rules committees as we work with the Biden administration.”

    This isn’t just DiFi walking away, this is DiFi being forced out by Chuck Schumer. Dianne’s display of decorum during the Barrett confirmation was a step too far for the extreme left wing of the democratic party.

    While offering support for the president’s legal efforts to ensure election integrity, Leader McConnell is preparing to fight for his majority in the Senate in Georgia’s pair of runoff elections that will determine control of the upper chamber. The overtime elections for GOP Sens.     The Senate commerce committee held hearings with the CEOs of Google, Facebook and Twitter today. From the official press release:

    The hearing will examine whether Section 230 of the Communications Decency Act has outlived its usefulness in today’s digital age. It will also examine legislative proposals to modernize the decades-old law, increase transparency and accountability among big technology companies for their content moderation practices, and explore the impact of large ad-tech platforms on local journalism and consumer privacy. The hearing will provide an opportunity to discuss the unintended consequences of Section 230’s liability shield and how best to preserve the internet as a forum for open discourse. 

    Twitter’s Jack Dorsey, Facebook’s Mark Zuckerberg and Sundar Pichai of Alphabet (Google) all appeared remotely.

    I’m going to concentrate on Jack’s answers here. Pichai is a non-entity, a figurehead who is trotted out for performances like today. I’m pretty sure everyone is aware that Zuckerberg is an Android (does he dream of electric sheep?).
