NYC subway hero and former Marine Daniel Penny has been found not guilty on the charge of negligent homicide.
Penny, 26, was charged in the death of Jordan Neely, a mentally ill career criminal and addict who died after being restrained by Penny. Neely had been making threats to subway riders when Penny intervened.
The trial was not without controversy. The Judge in the case, Maxwell Wiley, seems to have violated state law by dismissing the most serious charge, Manslaughter 2, and proceeding with the lesser included offense of negligent homicide. There have also been ongoing threats of violence from BLM agitators outside the court room.
Penny’s legal troubles are not over yet. Andre Zachary, Jordan Neely’s estranged father is suing Penny in civil court. The acquittal in the criminal trial will go a long way in mitigating the civil trial.
