Breaking: Jack Smith Moves For Dismissal

Jack Smith, the unconstitutionally appointed special council tasked with prosecuting Donald Trump on a variety of charges has just filed a motion to dismiss the charges in the DC circuit court. Those charges are related to January 6 and an alleged conspiracy to overturn the results of the 2020 election. You can read the entire motion below.

In the filing, Smith relies on the OLC finding that a sitting president cannot be indicated or tried for criminal charges. Smith noted the prohibition on prosecuting presidents is “categorical and does not turn on the gravity of the crimes charged, the strength of the Government’s proof, or the merits of the prosecution, which the Government stands fully behind.”

The document charges in Florida are also being dismissed at least for Trump. The charges are still pending for Walt Nauta and Carlos De Oliveira, Trump’s co-defendants in that case.

I should note that the motion does not ask for the charges to be dismissed with prejudice, meaning the charges could be refiled once Trump leaves office in 4 years.

This is a breaking story and will be updated if and when necessary.

Update: A copy of the plea deal can be found here.

    Original Story

After half a decade of investigation, Hunter Biden has been charged with failure to file taxes. According to a court filing, the president’s son will plead guilty to two charges as part of a plea agreement.

As to his illegal possession of a firearm, relating to his lying on a federal form to obtain a gun while on drugs, the younger Biden has agreed to enter a pre-trial diversion program, which means the charge will be dropped as long as he doesn’t violate the law again.

Chris Clark, Hunter’s criminal defense lawyer, in a statement, said, “With the announcement of two agreements between my client, Hunter Biden, and the United States Attorney’s Office for the District of Delaware, it is my understanding that the five-year investigation into Hunter is resolved.”

“Hunter will take responsibility for two instances of misdemeanor failure to file tax payments when due pursuant to a plea agreement,” Clark said.

From what we currently know about the plea deal (which is mostly via Hunter Biden’s lawyer), it does not appear Hunter Biden will be charged with tax evasion, a charge that was originally reported as being part of the prosecution. Other charges involving fraud or the more salacious things revealed on his infamous laptop also look to now be off the table.

A misdemeanor failure to file taxes is usually handled with a fine, so it’s probable Hunter Biden never sees the inside of prison at this point. That’s a pretty sharp turnaround from what expectations were given the original seriousness of his crimes.

There’s really no way to spin this other than it looks like Hunter Biden got off easy as far as the charges he received and plead guilty to. At least that’s how many in the general public will see it. As a first-time offender, the deal isn’t unusual (as long as you have top-notch lawyers), but the absurd length of the investigation culminating in a couple of misdemeanors and fines is not going to build any new trust in an already controversial DOJ.

It is worth noting that this investigation and the preceding charges do not deal with anything involving the ongoing Biden bribery scandal. There’s no indication the DOJ and FBI are even looking into that matter, though. Only Republicans in Congress are actively investigating, and any conclusions they draw won’t be backed by the weight of law enforcement.

Most people on the right (and perhaps no small number of independents) are going to see how this played out and see political bias. I don’t blame them for that.

    Suspect in Sheriffs Ambush Charged

LA County Sheriff Alex Villanueva has announced a suspect has been charged in the ambush shooting of two deputies earlier this month.

Deonte Lee Murray, 36, was taken into custody after a lengthy standoff three days after the deputies were shot, though his arrest was unrelated to the attack on the deputies, Sheriff Alex Villanueva said.

Murray, who has suspected gang ties, was charged with one felony count each of carjacking, second-degree robbery, and assault with a firearm at the time of his arrest. The charges also included allegations of association with a criminal street gang, discharging a rifle inflicting great bodily injury, and personal use of an AR-15.

    Barr: Charge Rioters Aggressively

Attorney General Bill Barr told federal prosecutors to charge rioters aggressively in a recent conference call.

According to the Wall Street Journal:

Attorney General William Barr told the nation’s federal prosecutors to be aggressive when charging violent demonstrators with crimes, including potentially prosecuting protesters for plotting to overthrow the U.S. government. [….]

Barr warned that sometimes violent demonstrations across the U.S. could worsen as the November presidential election approaches. He encouraged the prosecutors to seek a number federal charges, including under a rarely used sedition law, even when state charges could apply.

As of now, there are around 200 cases pending related to the rioting around the country. And as has been shown, there’s an organized driving force behind the violence.

There are some, on the left of course, who think the additional penalties brought by federal charges are excessive. Buzzfeed wrote an entire article about it. Their complaint? The pair of NYC lawyers that got caught throwing firebombs at police vehicles are facing a potential life sentence. The authors tried to excuse the firebombing by saying the vehicles had already been damaged and were unoccupied.

So far this year, the riots have caused upwards of $2 Billion in damages according to an insurance industry report.
