    Questions of Fraud and the Denial of Constitutional Amendments and Their Protections 

    Author’s note:  I am not an attorney, simply a lay person who is concerned about the turn of events in my country.  As such, I have read the Constitution of the United States and the Amendments thereto.  I am going to use three publications to explain why I feel as I do about the Trial of Donald J. Trump and his fight against a corrupt judge and an overly ambitious Attorney General.                                                                

    The Constitution of the United States was adopted July 2, 1788 and became effective March 4, 1789.

    The first publication I refer to will be Webster’s New Collegiate Dictionary, copyright 1945.

    The second publication I will refer to will be “Your Rugged Constitution”, written by Bruce Allyn Findlay and Esther Blair Findlay copyright 1950 and copyright 1952 by the trustees of the Leland Stanford Junior University.                                                                                                                                                                           

    The third publication I will refer to will be “The Constitution of the United States, its sources and its applications”, written by Thomas James Norton copyright 1922. 1940 by the World Publishing Company and copyright 1943 by Committee for Constitutional Government Inc.

    First publication:  I will explore a definition of “Fraud” as defined by Webster’s New Collegiate Dictionary.  #4: Law, “An intentional perversion of truth to induce another to part with some valuable thing belonging to him or to surrender a legal right”.                                                                                                           

    My question is, how can there be even the perception of impartiality by Judge Engoron when he stated before the trial had even begun that Mr. Trump was guilty of fraud before any testimony had even been heard?

    In the second and third publications: I will explore the “8th Amendment to the Constitution” adopted in 1791 which Reads: “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishment inflicted”.                                                                                                                     

    The fines levied against Donald Trump by the court far exceed the definition of “excessive” and as such should be prohibited from being enforced.

    I shall further explore the “14th Amendment to the Constitution”, Section 1 which reads: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside”                      

                                                                                       

    Section 1 of the 14th Amendment further reads: “No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States, nor shall any state deprive any person of life, liberty, of property without due process of law, nor deny to any person within its jurisdiction the equal protection of the laws.”

    Again, my question is how can there even be the perception of fairness when Mr. Trump has been denied the right to present evidence that denigrates the statements of Judge Engoron?  Evidence that would flat-out deny the judge’s statement and that of Attorney General Letia James that he excessively inflated the stated worth of his properties when even the bankers who made the loans said that there was no evidence of fraud; either in the paperwork that accompanied the loan applications and on closing that all monies borrowed had been dutifully paid in full and within the time frame for repayment.

    Again I state, I am not an attorney, but am aware that in my mind Mr. Trump has been denied the protections of the Constitutional Amendments by a judge who’s partiality and downright denial of said protections seems to be unlawful and beyond the pale of legal and just application of the laws as set forth in the Constitution and the attending Amendments.

    Trump Responds to The Washington Post’s Correction….

    Trump Responds to The Washington Post’s Correction on His Call With Georgia Election Investigator

    Former President Donald Trump issued a lengthy statement following The Washington Post’s correction of a false quote it published in January that claimed he had told Georgia’s top elections investigator in a phone call to “find the fraud.”

    Trump in a statement to news outlets said he appreciates the correction but would “further appreciate a strong investigation” into allegations of election fraud in Georgia’s Fulton County, as well as an investigation into what he called the “Stacey Abrams political machine.”

    Trump campaign adviser Jason Miller also weighed in on the retraction, saying in a Twitter post, “Time for some other media outlets to correct their fake news coverage of this story as well. You know who you are!”

    The Washington Post, known for its prominent anti-Trump slant, issued a correction on March 11 to a story it published in January after an audio recording emerged of a phone call Trump had in December 2020 with an investigator working from Georgia Secretary of State Brad Raffensperger’s office.

    The correction said the paper’s January story about the call included quotes that didn’t exist in the audio recording.

    “The recording revealed that The Post misquoted Trump’s comments on the call, based on information provided by a source. Trump did not tell the investigator to ‘find the fraud’ or say she would be ‘a national hero’ if she did so,” The Washington Post said.

    Trump said in the statement Monday via his Save America political action committee (PAC): “The Washington Post just issued a correction as to the contents of the incorrectly reported phone call I had with respect to voter fraud in the Great State of Georgia. While I appreciate The Washington Post’s correction, which immediately makes the Georgia Witch Hunt a non-story, the original story was a Hoax, right from the very beginning.

    “I would further appreciate a strong investigation into Fulton County, Georgia, and the Stacey Abrams political machine, which, I believe, would totally change the course of the presidential election in Georgia,” he added.

    The president went on to criticize the establishment media. “You will notice that establishment media errors, omissions, mistakes, and outright lies always slant one way—against me and against Republicans. Meanwhile, stories that hurt Democrats or undermine their narratives are buried, ignored, or delayed until they can do the least harm—for example, after an election is over.

    “Look no further than the negative coverage of the vaccine that preceded the election and the overdue celebration of the vaccine once the election had concluded,” he added. “A strong democracy requires a fair and honest press. This latest media travesty underscores that legacy media outlets should be regarded as political entities—not journalistic enterprises. In any event, I thank The Washington Post for the correction.”

    Fulton County

    Georgia made news headlines around the country for multiple allegations of voting irregularities and election fraud. Trump in his Monday statement said there was a lack of proper audits in Fulton County.

    “Fulton County has not been properly audited for vote or signature verification,” Trump continued. “They only looked at areas of the State where there most likely would be few problems, and even there they found large numbers of mistakes. We are seeking to find and reveal the large-scale election fraud which took place in Georgia. Many residents agree, and their anger caused them not to turn out and vote for two Republican Senators in the January election.”

    Fulton County was where the majority of complaints about potential voting fraud were lodged. In one notable case, video footage emerged of the State Farm Center, a site in the county where vote counting was being done for the 2020 presidential election. The footage showed that in late hours of Nov. 3 and early Nov. 4, election workers continued to wheel out boxes of ballots from under a table and count the ballots after observers and other workers had left the room.

    Trump previously announced on Twitter that he had asked Raffensperger about election-related irregularities in Georgia, including in Fulton County, but Raffensperger dismissed the claims.

    Trump said, “He was unwilling, or unable, to answer questions such as the ‘ballots under table’ scam, ballot destruction, out of state ‘voters’, dead voters, and more. He has no clue!”

    Consent Decree

    The former president on Monday separately criticized a “consent decree,” a legal settlement that was signed by Raffensperger on March 6, 2020, following a lawsuit by the Democratic Party.

    Trump and his lawyers said they think the consent decree weakened signature matching and the ability to verify legal votes for the 2020 election.

    Raffensperger disputed Trump’s assertions and told The Associated Press that there is nothing in the consent decree that prevents Georgia election clerks from scrutinizing signatures, adding that not only is it possible to verify signatures, this is required by state law.

    When a voter requests an absentee ballot on a paper application, he or she must sign it. Election officials compare that signature to the signature in voter registration files before a ballot is sent to the voter, Raffensperger said. When those ballots are returned, the required signature on the outer envelope is compared to signatures in the voter registration system.

    But Doug Collins (R-Ga.) said on Nov. 24, 2020, that once the ballot is taken out of the envelope and separated, there is no way to track the signature to verify whose ballot it is.

    Georgia attorney L. Lin Wood, in a lawsuit against Raffensperger, argued that the consent decree is unconstitutional because it didn’t get approval from the state legislature. The U.S. Constitution stipulates that only state legislatures and Congress can prescribe the “times, places, and manner of holding elections.”

    The Supreme Court has since denied Wood’s petition to hear the case after it was dismissed in federal court. A district court judge in Georgia said Wood had failed to demonstrate a “substantial likelihood of success” to his claims.

    “The Consent Decree signed between Raffensperger and Stacey Abrams was not approved by the Georgia State Legislature, and therefore should be deemed invalid, and the election result changed,” Trump said in his statement on Monday. “Why the Governor [Brian Kemp] and Raffensperger ever approved this Consent Decree is one of the great questions? We look forward to an answer.”

    Trump had previously criticized the decree on Twitter on Nov. 14, 2020. He wrote, “The Consent Decree signed by the Georgia Secretary of State, with the approval of Governor @BrianKempGA, at the urging of @staceyabrams, makes it impossible to check & match signatures on ballots and envelopes, etc. They knew they were going to cheat. Must expose real signatures!”

    Stacey Abrams, who lost the 2018 Georgia gubernatorial election, had made claims of voter suppression. Her organization and the Democratic Party moved to sue the state of Georgia, arguing that minorities were disproportionately affected when they had their ballots rejected in the 2018 gubernatorial election.

    Abrams has founded multiple organizations, including Fair Fight 2020, “an initiative to fund and train voter protection teams in 20 battleground states.” Much of that effort has been to expand mail-in voting.

    Raffensperger’s office and Abrams did not immediately respond to The Epoch Times’ request for comment.

    Comment: Stacy Abrams is as they say, “a person of interest” to me.

    But Abrams’ excuses ignore reality. The facts are that she made over $1 million dollars in five years as a tax attorney and – while still owing $54,000 to the IRS – she loaned herself $50,000 to run for governor. Abrams clearly had the means to pay her fair share as a taxpayer, but chose instead to fund her own political ambitions.     In 2019 those debts were all satisfied or cleared as reported in the Hill on May 16, 2019
    A spokesperson for Abrams told the Atlanta Journal-Constitution Thursday that Abrams settled the approximately $54,000 she owed the federal agency as well as separate credit card and student loan debt.
    Abrams had reported the debt during her campaign last year against then Georgia gubernatorial candidate, Brian Kemp (R).     Trump Criticizes Biden as Border Crisis Escalates

    Former President Donald Trump excoriated President Joe Biden on Friday over the worsening crisis on the southern border, calling his successor’s leadership “disastrous.”

    “Our border is now totally out of control thanks to the disastrous leadership of Joe Biden,” Trump wrote in a statement released on March 5 through an intermediary.

    “Our great Border Patrol and ICE agents have been disrespected, demeaned, and mocked by the Biden Administration,” Trump added, referring to the Immigration and Customs Enforcement agency.

    “A mass incursion into the country by people who should not be here is happening on an hourly basis, getting worse by the minute. Many have criminal records, and many others have and are spreading covid,” he wrote, referring to COVID-19, the disease caused by the CCP (Chinese Communist Party) virus.

    Trump issued that statement as the Biden administration struggles to contain a deepening crisis on the border. The latest illegal alien influx was triggered by the undoing of several key Trump immigration policies designed to discourage border crossings.

    “We don’t take our advice or counsel from former President Trump on immigration policy, which was not only inhumane but ineffective over the last four years. We will chart our own path forward including treating children with humanity and respect and ensuring their safety when they cross our borders,” White House Press Secretary Jen Psaki told reporters on Friday.

    Biden told reporters on Tuesday that the border situation did not amount to a crisis.

    “We’ll be able to handle it, God willing,” the president said.

    The number of illegal crossings has steadily increased since the presidential election in November, particularly by unaccompanied minors. The Biden administration opened overflow shelters to handle the influx and has begun to release minors to relatives and sponsors in the United States to clear space.

    The Trump administration used its public health authority to expel crossing minors, a policy that both stemmed the tide of illegal aliens and deterred further crossings. The Biden administration said it would discontinue the practice. Sen. Ron Johnson (R-Wis.) sent a letter to Homeland Security Secretary Alejandro Mayorkas on March 1, questioning the rationale for axing the policy, citing recent reports about illegal aliens who tested positive for the CCP virus after crossing the border into the United States.

    “Refusing to use the authorities available to law enforcement during a global pandemic creates unsafe conditions for Border Patrol agents and the broader public, as well as for the children traveling to the border,” Johnson wrote. “Not surprisingly, it is also resulting in a surge at the southwest border that our facilities and infrastructure are not able to handle.”

    In the brief statement, Trump also decried the temporary enforcement freeze which has suspended nearly all deportation proceedings, including those for aliens with criminal records.

    “Interior enforcement has been shut down—criminals that were once promptly removed by our Administration are now being released back onto the street to commit heinous and violent crimes,” Trump said. “ICE officers are desperate to remove these convicted criminals, but Biden won’t let them.”

    Number of migrant children crossing the border on pace to shatter all-time record

    Members of the Domestic Policy Council were set to tell President Biden Tuesday that the number of migrant children who cross the southern border this year is on pace to exceed an all-time record — by 45 percent — citing unreleased data from the Department of Homeland Security.

    In a presentation made up of nearly 40 slides obtained by Axios, the DPC cites data from DHS and the Department of Health and Human Services to warn that the Biden administration is 20,000 beds short of what it needs to properly house the 117,000 unaccompanied child migrants expected to cross the border this year.

    Despite establishing multiple new tent-style shelters and loosening COVID-19 restrictions, the DCP is telling Biden that the administration will fall short of its needs by a couple thousand.

    The replacement of former President Donald Trump, who maintained a hard line on immigration, with Biden, who has undone some of his predecessor’s key border initiatives, has set off a new caravan to the US border of Central American and Mexican migrants, including thousands of unescorted children.

    In his first month, Biden ended construction of Trump’s signature US-Mexico border wall and began to end the “Remain in Mexico” policy under which about 71,000 Central American asylum applicants were awaiting rulings in Mexico. He issued an order affirming the 2012 Deferred Action for Childhood Arrivals program, which gives work permits and protection from deportation to people brought illegally to the US as minors, and proposed legislation that would create a path to citizenship for the estimated 11 million illegal immigrants in the US.

    The White House declined to comment Tuesday when reached by The Post. A spokesperson for DHS did not immediately respond to a request for comment.

    During Tuesday’s White House press briefing, press secretary Jen Psaki was asked about the numbers, as well as DHS Secretary Alejandro Mayorkas’ insistence a day earlier that there was not a crisis at the border.

    “Well, I’ll leave that to the Secretary of Homeland Security to define,” Psaki began, “He said it was a challenge, it is a challenge.

    “We have more than 7,000 unaccompanied kids who have come into the United States, and that is certainly a lot of children that we are trying to treat humanely and safely and processed through the system as quickly as we can,” she continued, calling it “not easy.”

    She went on to note that the president was regularly briefed by the DPC.

    While claiming that the border was not facing a crisis, Mayorkas said while speaking to reporters Monday that the problems the agency did face should be blamed on the previous administration.

    “Let me explain to you why [fixing the broken immigration system] is hard and why it is going take time. I think it is important to understand what we have inherited because it defines the situation as it currently stands. Entire systems are not rebuilt in a day or in a few weeks,” he began. “To put it succinctly, the prior administration dismantled our nation’s immigration system in its entirety.”

    Mayorkas’ comments came before reporters had been given the chance to ask any questions, making it clear he was likely expecting questions on the burgeoning crisis at the US-Mexico border, a crisis that has erupted in the month since Biden was sworn in.

    When taking questions, he was also asked by an ABC News reporter why he was told members of the press would be not be able to tour migrant facilities in Texas. The reporter had been told the administration would not allow such tours due to coronavirus restrictions.

    Mayorkas replied that he would look into the matter.

    Pressed by the Daily Caller, the Health and Human Services Administration for Children and Families (ACF) affirmed, “The Office of Refugee Resettlement (ORR) is not hosting media tours of unaccompanied children (UC) facilities currently due to the COVID-19 pandemic,. If media tours resume, we will send a media advisory.”

    Trump Creates ‘Office of the Former President’ to Advance US Interests, Carry on Trump Admin Agenda

    Former President Donald Trump opened an “Office of the Former President” on Monday that seeks to advance the interests of the United States and carry on the agenda of his administration.

    A statement from the office in Palm Beach County, Florida, reads, “Today, the 45th President of the United States, Donald J. Trump, formally opened the Office of the Former President.”

    “The Office will be responsible for managing President Trump’s correspondence, public statements, appearances, and official activities to advance the interests of the United States and to carry on the agenda of the Trump Administration through advocacy, organizing, and public activism.

    “President Trump will always and forever be a champion for the American People,” it said.

    There have been many questions as to whether or how Trump would engage in politics after he left office. Trump made his first political move after leaving the White House on Jan. 22 when he in a phone call endorsed Kelli Ward, who was later reelected as the Arizona Republican Party Chairwoman.

    Trump also released a statement late Monday endorsing his former press secretary Sarah Huckabee Sanders in her campaign for Arkansas governor.

    The announcement of the “Office of the Former President’ comes shortly before the House of Representatives delivered a single impeachment charge to the Senate late Monday. The “incitement of insurrection” charge claims that Trump was responsible for inciting an insurrection that resulted in riots at the U.S. Capitol on Jan. 6.

    Although Trump left office on Jan. 20, Senate leaders are determined to press forward. If convicted, senators can then choose to disqualify the former president from ever holding office again.

    Some Democrats are also looking at using the Constitution’s 14th Amendment to bar him from holding office.

    When Trump left Washington for Florida on Jan. 20, he told supporters that he and his team would “be back in some form.”

    “We love you. We will be back in some form,” he said at the time. “I will always fight for you. I will always be watching. I will be listening.”

    Trump later made remarks in a similar vein, saying that he’ll make a comeback in some way. “We’ll do something, but not just yet,” Trump told Rob Crilly of the Washington Examiner on Friday, without elaborating.

    Former U.S. Ambassador to Germany Richard Grenell said over the weekend that Trump had told him that he wants to run for the presidency again. Grenell told Newsmax, “He’s told me personally, multiple times, that he does want to run again. So we’ll see if that holds and how that comes about; I think we’ve got a long ways to go.”

    Jason Miller, a campaign adviser, said earlier this month that Trump would be involved in the 2022 midterms with the immediate focus being to help Republicans win back both chambers of Congress. It is unclear whether he would run for president in 2024.

    Miller also told The Epoch Times on Monday that Trump and his team do not have any affiliation with a newly formed political committee called the MAGA Patriot Party, amid speculation that Trump would try to form a third party.

    Comment: I believe all Americans regardless of one’s political position is experiencing first hand, how ruthless the Democratic Party intends to govern and what poor representation can be anticipated from the Republicans. However, what is very clear – whether we look at the removal of President Trump’s access to Twitter, Facebook, & Instagram accounts or his bank closing his accounts or the tabling of another Impeachment subsequent to his leaving office. These people (Capitol Comrades) are not going to leave him or his family alone, until they completely destroy them, if they can. Or for that matter his 75+ million supporters; which the MSM have labeled as terrorists & insurrectionists, that require re-education or de-propramming. No, I think President Trump & his family anticipated this and so did we – so my suggestion is act accordingly. Maintain pressure with truth & facts & the rule of law.
